- Result: Case Dismissed Charge: Driving While Intoxicated w/ .295 BAC Facts: Officer claimed the client was driving in the parking lot. Client failed field sobriety tests and refused breath and blood test. The officer obtained a warrant and blood was drawn at the jail. The blood test came back at a .295. At the ALR hearing, we thoroughly cross-examined the officer. The officer answers were insufficient to prove even probable cause for the arrest. The State had no way to proceed with the criminal charges. Case Dismissed.
- Result: Case Dismissed Charge: Assault/Family Violence Facts: Client became emotional with spouse while riding in the car. The client hit the spouse numerous times and prevented client from calling 9-1-1. Case Dismissed.
- Result: Case Dismissed/Expunged Charge: Assault/Family Violence with Injury Facts: Client had a little too much to drink at a family gathering. At the gathering she started hitting her husband, causing him injury. Case Dismissed.
- Result: Case Dismissed Charge: Assault/Family Violence Facts: Client arrested for hitting her husband and knocking the phone out of his hand as he was calling 9-1-1. Case Dismissed.
- Result: Case Dismissed Charge: Possession of a Controlled Substance Facts: Nursing student in his final year was arrested for cocaine. A conviction would have impacted his ability to get a job after graduation. Case Dismissed.
- Result: Case Dismissed Charge: Possession of a Controlled Substance Facts: Client was arrested for a DWI and a search of the vehicle revealed a substance that tested positive for Meth. Case Dismissed.
- Result: Case Dismissed Charge: Possession of Marijuana Facts: Client was arrested for Possession of Marijuana as he was being arrested for Public Intoxication for riding with a friend who was arrested for Driving While Intoxicated. The officers claimed to smell an odor of marijuana emitting from the car. When searching the client incident to the Public Intoxication arrest they found Marijuana in client’s pocket.
- Result: Case Dismissed Charge: Possession of Marijuana Facts: Officer stopped client for expired registration. While speaking with the client the officer claimed to smell marijuana and seeing the client having a “green tongue”. Case dismissed due to police procedure errors.
- Result: Case Dismissed Charge: Driving While Intoxicated with Open Container Facts: Client was stopped for swerving within his lane and changing lanes without a turn signal. Client failed the field sobriety test and police drew blood pursuant to a search warrant. The client is a college professor that was up for tenure and in the United States on a green card. Although the facts were not in our favor we negotiated a dismissal based on the interest of justice not being served with a DWI conviction in this case.
- Result: Case Dismissed Charge: Driving While Intoxicated 2nd w/ Accident Facts: Client was driving home from bar with wife. On the way he took a turn too fast and flipped his SUV several times. The vehicle landed upright so client finished driving home. When almost home an officer noticed he had a tail light out (broken in the accident). As the officer got closer he noticed vehicle was in an accident. Officer noticed beer cans and a half filled liquor bottle throughout the car (it flipped). The client previously did seven years for Intoxication Manslaughter in another state. On the day of trial the state dismissed due to issues with the officer’s investigation that our attorneys noticed based on their prior law enforcement experience.
- Result: Case Dismissed Charge: Driving While Intoxicated w/ Accident Facts: Client took a turn too fast and wrecked sports car. Client failed field sobriety tests and provided a breath sample of a .13 (over 1 1/2 times the legal limit). The case was set for trial and reduced to a deferred Class C traffic citation on the trial date. After six months the traffic citation was dismissed. Case Dismissed.
- Result: Case Dismissed/Expunged Charge: Driving While Intoxicated Facts: Officer clocked client driving 115 mph on I-35. Client failed field sobriety tests and provided a breath sample of .12 (1 1/2 times the legal limit). The client was at risk of deportation if convicted of a DWI. On the date of trial, the state agreed to a deferred Class C speeding ticket. After six months the speeding ticket was dismissed. Case Dismissed/Expunged.
