  • In today’s fast-paced legal litigation environment, it is extremely tempting to send out “cookie-cutter” written discovery to the adverse counsel. This templated approach is generally sufficient in simple personal injury cases; however, as the fact-pattern of a personal injury case becomes more complex (e.g. the defendant is a company/corporation; the fact pattern involves culpability of more than one defendant; the fact pattern warrants numerous and separate allegations against the defendant and/or defendants) boiler-plate written discovery is not only deficient, it can become a legal malpractice issue. As such, when handling complex personal injury cases, it is generally prudent to start at the end and work backwards.
