  • Probate Related Representation: Defended trustee and executor in family dispute involving breach of fiduciary duty claims.  Obtained favorable settlement for client on eve of trial. Prosecuted breach of fiduciary duty claims against trustee in Probate Court No. 1 of Bexar County, Texas. Obtained judgment against fiduciary.
  • Bankruptcy Related Representation: Secured take-nothing jury verdict in fraudulent transfer action brought by federal equity receiver in Ralph S. Janvey, in his capacity as court-appointed receiver for The Stanford International Bank, Ltd et al. v. Dillon Gage Inc. of Dallas and Dillon Gage, Inc., Cause No. 3:10-cv-1973, in the U.S. District Court for the Northern District of Texas.   Represented Wellness International Network, Ltd. in an adversary proceeding in the Northern  District of Illinois against a debtor and obtained a favorable judgment invalidating a trust, which was subsequently upheld by the U.S. Supreme Court in Wellness International Network, Ltd v. Sharif, 135 S.Ct. 1932 (2015) as permissible under Article III and within the jurisdiction of the bankruptcy court upon the parties' consent.  Prosecuted fraud and contract claims with damages in excess of $75 million on behalf of liquidating trust and obtained a favorable settlement following jury selection in MC Asset Recovery, LLC v. Castex Energy, Inc. et al., Cause No. 4:07-CV-076-Y, in the U.S. District Court for the Northern District of Texas.  Prosecuted avoidance and fraud claims against controlling entity and entity's former directors and officers on behalf of liquidating trust and obtained favorable settlement in Holliday v. K Road Power Management, LLC et al., Adversary No. 12-01879, in the U.S. District Court for the Southern District of New York.
