Seth Reich is a principal at Caldwell Cassady & Curry who focuses his practice on patent litigation and complex commercial litigation. Mr. Reich has served as counsel for both plaintiffs and defendants in cases involving patent infringement, contract disputes, contested trademarks, and trade secrets claims, among others.

Mr. Reich provides in-depth experience litigating standard essential patents (SEPs), including navigating fair, reasonable, and non-discriminatory (FRAND) obligations. His SEP-related experience includes litigation involving 3GPP, ITU, IEEE, and ETSI standards, as well as technology related to LTE, 3G, 2G, and other telecommunication standards. Mr. Reich’s SEP work has resulted in favorable settlements for his clients both before and after trial.

Mr. Reich's track record at Caldwell Cassady & Curry includes his work as trial counsel for Acantha LLC in the company's patent infringement litigation against DePuy Synthes, a subsidiary of healthcare giant Johnson & Johnson. Jurors in the U.S. District Court for the Eastern District of Wisconsin issued an $8.2 million verdict against DePuy Synthes after finding that the company infringed an Acantha patent covering an orthopedic implant assembly.

He also has played a key role in Caldwell Cassady & Curry's ongoing representation of VirnetX Inc. in the company's patent litigation against technology powerhouse Apple Inc. Those wins for VirnetX include a unanimous verdict of $502.6 million in 2018 in the U.S. District Court for the Eastern District of Texas and a separate verdict of $502.8 million handed down by a different Eastern District jury in 2020.

Mr. Reich has also represented Texas Instruments in a number of patent infringement matters throughout Texas. One of those cases in the Eastern District of Texas, Vantage Micro LLC v. Texas Instruments, involved allegations of infringement related to TI’s fabrication processes. After moving for early summary judgment and to dismiss certain claims for lack of standing, the case settled on favorable terms to TI before the claim construction hearing.

Mr. Reich has litigated cases in state and federal courts throughout the country. He is licensed to practice in Texas state courts, the U.S. District Courts for the Northern, Eastern, and Western District of Texas, the U.S. District Court for the Eastern District of Wisconsin, and the U.S. Courts of Appeals for the Federal, Fifth, and Eleventh Circuits. He has substantial experience in all phases of litigation – including experience with depositions, trials, critical motions, and appellate work – and he has been a part of multiple cases that have resulted in favorable jury verdicts and settlements for his clients.

A member of the Dallas Bar Association and the Dallas Association of Young Lawyers, Mr. Reich was selected as part of the 2015 DAYL Leadership Class. He also was honored with the 2016 DAYL Pro Bono Service Award based on his pro bono work for clients in immigration proceedings, appellate briefings, death penalty litigation, and intellectual property matters for non-profit startups.

Mr. Reich earned his law degree, magna cum laude, at the Duke University School of Law. He earned his undergraduate degree in electrical engineering, magna cum laude, at Louisiana State University.

During law school, he worked as a Symposium Editor for the Law & Contemporary Problems Journal and a staff editor for the Duke Law & Technology Review. He claimed first-place honors in both the Kilpatrick Townsend and Twiggs-Beskind mock trial competitions.
