Since 1992, Thomas Brandt has been a member of Fanning Harper Martinson Brandt & Kutchin, P.C., where he leads the firm’s local government and employment law section. His litigation track record includes significant cases at every level of the state and federal courts, including numerous cases before appellate courts, the Supreme Court of Texas, and the United States Supreme Court.

In addition to his active litigation practice, Mr. Brandt also performs general counsel services for several local government entities and private businesses. He also has handled high-profile public integrity investigations, including two involving allegations of wrongdoing by major city police chiefs.

Tom began his career as a prosecutor in the Dallas City Attorney’s office, where he handled numerous trials and appeals in matters involving civil rights, false arrest, excessive force, and race discrimination. In his work for the City of Dallas, he assisted in the preparation of briefs and the presentation of oral argument before the U.S. Supreme Court in FW/PBS, Inc. v. City of Dallas, 493 U.S. 215 (1990), which involved the city’s ordinance on sexually oriented businesses.

Tom has handled numerous, high-profiled cases involving complex issues of constitutional law. Tom has earned a reputation as an expert in First Amendment litigation having dealt with cases involving freedom of speech, freedom of religion and the Establishment Clause. Tom has also earned a reputation as an expert in the Fourth and Fourteenth Amendments having successfully handled numerous cases involving issues of illegal search and seizure and issues of due process. A recognized leader in civil rights litigation, Tom has had many notable victories.

One case that is particularly notable involved Tom’s victory over two former solicitor generals. Tom successfully argued that case before the en banc United States Court of Appeals for the Fifth Circuit. See Morgan v. Swanson, 659 F.3d 359 (5th Cir. 2011) (en banc).

Tom is a recognized leader in the area of school law. One recent notable victory in this area is Estate of Montana Lance v. Lewisville ISD, 743 F.3d 982 (5th Cir. 2014).

Tom has been a leader in the legal profession for many years and is an “AV” rated lawyer, the highest rating awarded by Martindale Hubbell. He also has earned multiple selections to the Texas Super Lawyers list.
