Attorney Profile

I am a trial lawyer who is passionate about providing vital advocacy (@vitaladvocacy) in difficult, high stakes or high-profile courtroom fights involving white collar criminal matters, major criminal matters, or complex civil litigation. Having tried more than 100 cases in my career, I enjoy representing clients who know that, for strategic or other reasons, plea or settlement is not an option and that they need to take their cases to trial. Essentially clients turn to me when they need to take their most important cases to trial--i.e., when they need vital advocacy.

Also, I simply enjoy just being in the courtroom. If you are going to or are in court on a major or complex criminal or civil litigation matter, however your case is to be resolved, whether by settlement, plea or trial, I'm pleased to stand with and for my clients in courtrooms.

  • According to VerdictSearch’s May 27, 2013 publication, Victor Vital secured the largest Texas employment verdict of 2012. Victor, a shareholder in the Dallas office of the international law firm Greenberg Traurig, LLP, led a team that won a $6.9 million verdict, including $1.75 million in punitive damages, for Horizon Health Corporation ("Horizon"), a wholly- owned subsidiary of Universal Health Services ("UHS").  VerdictSearch employs an editorial staff of over 25 lawyers, journalists and research associates who report on nearly 200 cases from around the nation every week, focusing on the most prominent verdicts in the country. Victor secured a verdict against five former executives of Horizon and two competitor companies on claims of breach of non-competition and no solicitation covenants, theft of trade secrets, breach of fiduciary duty, tortious interference, and fraud.   “I’m not at all surprised that Victor secured such a noteworthy verdict for his client,” says Steve Carlin, managing shareholder of Greenberg Traurig’s Dallas office,” Victor has a keen understanding of our clients’ needs and what it means to provide them with strategic and cost effective solutions in courtroom matters. He is a terrific trial lawyer who values client service above all else.”  UHS and Horizon are extremely pleased with the verdict and with Greenberg Traurig for securing it.  The Horizon president said that "Victor fought for us when we needed it most. He worked tirelessly to bring this issue to a close, securing a verdict that we felt was fair and exceeded our expectations."

Representative Clients:

  • CultureMap, LLPGreenberg Traurig secured a dismissal with prejudice as to defamation claims against an leading-edge digital media company, CultureMap, LLC, and its Dallas managing editor, Claire St. Amant. The case involved First Amendment issues and multiple defendants, as well as other claims, such as invasion of privacy and trespass. The lawsuit, filed by Dr. Richard and Leanne Malouf, alleged that the firm’s clients, CultureMap, LLC and Claire St. Amant, were liable for defamation arising from their reporting of the Maloufs' lawsuit against prominent media entities and personalities. Victor Vital, the lead partner for this high-profile matter, used an anti-SLAPP motion to prove that the lawsuit infringed on public participation rights under the Texas's Citizen Participation Act, which provides for the expedited dismissal of meritless "strategic lawsuits against public participation" ("SLAPP suits”). This dismissal saved his client additional time and fees and that would have been incurred had the company remained in the lawsuit through the summary judgment phase., 2013
  • Richard Kozuback andGlobal Entertainment Corporation Greenberg Traurig represented Global Entertainment Corporation and its CEO and President, Richard Kozuback, in defense of a Securities and Exchange Commission investigation action arising from a municipal offering related to the financing and development of an entertainment and events arena in Wenatchee, Washington.Victor Vital was the lead partner for this matter and finalized negotiations of a very favorable settlement (i.e., a mere $20,000 penalty, no disgorgement or other remedies or bars). This high-profile matter attracted national press coverage.
