  • Successful Resolution Of Nationally Publicized Construction Defect Claims On Behalf Of Subcontractor. In the highly publicized construction defect claim involving the multi-million dollar Allen football stadium, McCathern attorneys Paul Grinke and Ty Sheaks were able to successfully resolve potential claims on behalf of one of the subcontractors involved in original construction of the stadium through implementation of a detail-oriented and aggressive defensive strategy, 2015
  • Successful Resolution of Civil Wrongful Death Lawsuit On Behalf of Franchisee For National Restaurant Chain Franchisee. Plaintiffs asserted wrongful death, negligence and gross negligence claims against franchisee for national restaurant chain as well as the national restaurant chain itself for the tragic murder of their adult-son during a delivery as a driver for the franchisee. McCathern attorneys, Carl Evans and Ty Sheaks assisted the District Attorney’s Office during the criminal investigation and murder trial of the alleged attackers, which resulted in conviction and life imprisonment of the alleged shooter. Thereafter, McCathern attorneys meticulously implemented an aggressive common-sense approach to the civil matter, which resulted in a successful resolution of the matter on behalf of the franchisee client, 2015
  • Successful Resolution of FLSA Claims Pending In State Court As Well as Federal Class Action for Healthcare Client. Two former employees asserted FLSA claims against McCathern’s client, a professional medical services provider, as well as filing a class-action matter in Federal Court. After negotiating dismissal of the federal class action, Ty Sheaks’ detailed analysis of the relevant evidence and common-sense approach prompted successful resolution of the remaining FLSA claims pending in state court, 2015
  • Byrd v. DeLaSancha, 195 S.W.3d 384
  • Successful Resolution of Construction Related Wrongful Death Civil Lawsuit. Plaintiffs asserted wrongful death, negligence and gross negligence claims against the engineering firm responsible for design of a water treatment system when a tragic accident happened during construction that resulted in the unfortunate death of a worker on the project. After implementing an aggressive yet common-sense approach to defending the claims asserted by Plaintiffs, McCathern’s attorneys, Paul Grinke and Ty Sheaks, were able to successfully dispose of Plaintiffs’ claims for punitive damages through an appropriate summary judgment motion while at the same time asserting third-party claims against the decedent’s employer and successfully fending off summary judgment motions by the employer. Mere days before trial, McCathern’s attorneys were able to negotiate a successful resolution of the matter after asserting an additional motion for summary judgment which narrowed to scope of relevant law to effectively box the Plaintiffs in with respect to the issue of duty, 2015
