The recipient of numerous prestigious awards for his commercial litigation practice, Brent Perry draws on 30 years of experience representing clients in various business litigation and appellate matters. Bringing both a cordial, professional approach and zealous, determined advocacy skills, Brent helps resolve complex issues in securities, contracts, insurance, fiduciary, and other litigation. He also handles ownership and governance matters. His clients operate in the construction, health care, real estate, oil and gas industries, among many others. Brent, who has been Board Certified in Civil Trial Law, by the Texas Board of Legal Specialization since 2010, has earned a reputation across Texas and beyond for his ability to fully understand both the big-picture issues and the nuanced details of a case, strategically harness the relevant information, and craft and deliver a persuasive narrative to advance his clients’ interests. Before co-founding Burford Perry in 2015 with longtime friend Robert R. Burford, Brent served clients’ litigation needs in both large and small law firms. In these partnerships, he tried significant business disputes while developing a complementary appellate practice.

Verdicts / Settlements (Case Results)

  • Co-trial and appellate counsel for an independent natural gas marketing company that was sued by a natural gas storage facility developer over that company’s failed attempt to purchase a large storage facility. The developer sought over $500 million in damages plus exemplary damages and over $10 million in attorneys’ fees. The trial court entered judgment for only $2.35 million in damages and $1.18 million in fees after a jury verdict and substantial post-trial briefing.   • Co-counsel to Robert Burford representing Laura Yosowitz, whose Greenlet LLC ownership was devalued by Martin Kay's asset transfer to a new company. Pursuing a derivative action, Burford Perry transformed the dispute into a nine-figure lawsuit. After a compelling trial, the jury found Kay liable for $138 million in damages, confirming Yosowitz's ownership. The judge awarded her $54 million in damages and $2 million in attorneys' fees.   • Multiple appellate wins for clients WC4th and Rio Grande, LP, and WC4th and Colorado, LP in a complex property rights cases. Texas’ Eighth Court of Appeals and Third Court of Appeals reversed lower court decisions that threatened to strip Rio Grande and Colorado of assets worth well over $30 million. The opinions clarified the statutory limitations on turnover receivers.
  • Negotiated confidential, significant settlement for parents of college student who was fatally shot by private university police officer in an off-campus encounter. The case was the subject of two Texas Supreme Court opinions in 2017 and 2020. Redus v. University of the Incarnate Word
  • Obtained dismissal of mandamus action against Texas limited liability company in claims arising from $100 million investment.  Dismissal was affirmed on appeal.  
  • Obtained $4.5 million judgment for a Texas consulting firm against DSME, a Korean ship builder. Client assisted DSME in obtaining contracts worth almost $700 million to build LNG carriers. Judgment affirmed on appeal. Ikanco v. Daewoo Shipbuilding and Marine Engineering
  • Obtained precedent-setting victory in trial court and on appeal barring derivative actions on behalf of nonprofit corporations against their officers and directors. Tran v. Hoang 
  • Prosecuted shareholder oppression and fiduciary duty claims for the minority owner of a construction services company. During the prosecution of the case, the Texas Supreme Court sharply limited shareholder oppression actions. Successfully settled for most of the claimed damages, in excess of $3 million, on day before trial. Collins v. CAROL Crane
  • Resolved Texas Securities Act claims for Chinese and Texas investors who lost their multimillion-dollar investments in a Houston-based technology company. Panton, Inc. Securities Litigation
  • Co-counsel with Robert Burford in nine-day arbitration of derivative claims for one-third owners of a chain of Houston-area imaging centers. Obtained judgment confirming the arbitration award and awarding our clients over $7.4 million. Salim v. Cochinwala 
  • Stymied attempted dismissal of corporate officers and directors of publicly held company by majority shareholder, leading to successful arbitration against shareholder by the company. Reliability, Inc. v. Judos Trust, et al.
