Verdicts / Settlements (Case Results)

• Dustan represented a client charged with Indecency with a Child by Sexual Contact.  This allegation came from the mother of the child after the client was exercising his rights to visitation.  The mother did not want the client in the child's life.  This case was set for trial and ultimately dismissed at trial., 2025
• Dustan represented a client charged with Aggravated Assault with a Deadly Weapon.  The client was involved in a car accident without injuries and after exchanging information and waiting over 20 minutes for police to arrive, he decided he would leave the scene.  The people he was in the accident with claim that he tried to run them over with his car when they tried to stand in his way.  Once Dustan got involved, his team was able to track down independent witnesses and camera footage from a nearby business and a nearby home that showed the allegations did not exactly match what was said by the alleged victims.  Dustan put together a Grand Jury presentation and the case was "No Billed" by the Grand Jury., 2025
• Client was charged with Aggravated Sexual Assault of a Child.  18 year old client met a girl on social media who represented that she was 16 when in fact she was 14.  Because of the actual age difference, the client did not have the "Romeo and Juliet" defense when the parties are 3 years apart.  Dustan conducted his investigation and prepared a defense presentation for the Grand Jury.  After reviewing the case, the Grand Jury returned a "No Bill" ending the prosecution and giving the client his freedom., 2025
• Dustan represented a client charged with Unlawful Installation of a Tracking Device for placing airtags in a vehicle driven by his estranged spose.  The state argued that the spouse had a greater right of possession to the vehicle than the defendant had.  This case was taken to trial and a Jury returned a verdict of Not Guilty., 2025
• Client was charged with Assault - Family Violence relating to an incident where there was an argument and a struggle over a phone.  Dustan took this case to trial and after a three day trial to a Jury, a verdict of Not Guilty was rendered.  , 2025
• Dustan represented a client charged with felony assault by impeding breath and convinced the DA to dismiss the case on the day of trial.  A few months later, the DA re-filed the case as a misdemeanor.  We took this case to trial and the jury returned a verdict of Not Guilty.  This case was motivated by the alleged victim using the criminal justice system to gain advantage in a divorce child custody case.  Ultimately the client wouldn't plea to something he didn't do and the Jury made sure that justice was done., 2025
• Client was charged with drug trafficking in Federal Court.  Their prior attorney did not handle the case appropriately and the client was looking at a sentence of 10 years (120 months).  Dustan stepped in on the day of sentencing and was able to convince the court to grant a continuance of the sentencing and let him substitute the prior attorney.  After working through the case, the client ultimately received a sentence of 57 months. , 2025
• Client was charged with Money Laundering in Federal Court.  The guidelines recommended by US Probation called for sentence of 168 - 210 months because the money was alleged to be drug proceeds which would track the drug trafficking guidelines instead of the money laundering guidelines.  Dustan was able to convince the Court to reject the recommendation by US Probation and sentenced the client to 24 months according to the money laundering guidelines. , 2025
• Dustan represented client in Federal court for firearms trafficking for using straw buyers to purchase 50 caliber rifles for resale to drug trafficking organizations in Mexico.  The guidelines sentencing recommendation would have put the client in jail for 70 - 87 months.  After arguing against the Governments position at sentencing and preparing a thorough sentencing memorandum, the client received a 12 month sentence., 2024
• Dustan represented an 18 year old high school student that was charged with aggravated sexual assault of a child for having sex with a 12 year old girl that represented herself as being 16.  After our case investigation and preparation of a grand jury packet, the stated agreed to dismiss the charges., 2024
• Client was charged with assault family violence where the client was accused of assaulting an ex-girlfriend after an argument about money.  At trial we explained to the jury how this was a struggle over a cell phone and not an intentional assault.  They jury found the client Not Guilty., 2024
• Client was charge with aggravated assault with a deadly weapon.  She was delivering pizza to a customer.  The customer refused to pay for the pizza and then the client tried to leave, he grabbed her preventing her from leaving.  The client defended herself by stabbing the customer.  We presented the case to a grand jury and they agreed to "No Bill" the case resulting in charges being dismissed., 2024
• Juvenile client was charged with murder.  Self defense was an issue.  Jury found the client guilty because they felt that client did act in self defense when shooting the complainant.  However, client was sentenced to a term of probation. , 2024
• Dustan represented a Customs and Border Protection Office that was charged in Federal Court with Deprivation of Rights Under Color of Law and Falsification of a Document in a Federal Investigation.  After a week long trial, a jury returned a verdict of Not Guilty., 2023
• Dustan represented a client charged with assault on a peace officer as the result of a bar fight.  We presented our investigation to a grand jury and the case was no-billed., 2023
• Dustan represented a person charged as a habitual offender, looking at 25 years to life on an aggravated assault charge.  After a 2 week trial, the jury found the client guilty of a Class A misdemeanor and he received 30 days in jail., 2023
• Dustan represented a man charged with Murder.  We presented the case as self defense and convinced a grand jury to no-bill the case., 2022
• Dustan represented a man charged with continuous sexual abuse of a child. After a thorough investigation, Dustan was able to uncover evidence that cast doubt on the credibility of the witness.  This resulted in a day of trial dismissal.  , 2022
• Client was charged with 2 counts of aggravated assault for allegedly discharging a firearm during a road rage incident.  Dustan was able to convince the prosecution to dismiss on the day of trial., 2022
• Dustan represented a man charged with Aggravated Assault.  We presented the case as self defense to the grand jury based on a mob of people threating the client resulting in the use of the firearm and the grand jury returned a no bill and refused to indict., 2022
• Dustan represented a man charged with Murder who shot at a group of individuals who came to confront him and his bother when one of the men pulled a firearm.  We argued this was a case of self defense and demanded a jury trial.  After almost 3 years and multiple trial settings the case was finally dismissed.  , 2021
• Client was charged with felony assault in 3 different counties with the same alleged victim.  After a jury trial and a not guilty verdict, the other 2 cases were dismissed., 2021
• Client was charged with aggravated sexual assault of a child.  Dustan conducted a thorough investigation which involved obtaining school and counseling records as well as interviewing family members of the complainant. Dustan was able build a strong defense to show that it was factually improbable for the crime to be committed but also that there were witness credibility issues regarding the complainant.  On the day before trial, the state dismissed the case., 2021
• Dustan tried an assault of a family member case to a jury which resulted in the state dismissing the case in the middle of trial after the cross-examination of the first witness, 2020
• Client was charged with assault on a peace officer.  The client was at a bar and was trying to leave when a police officer decided to grab the client from behind and then injured himself while attempting to detain the client.  Dustan conducted an investigation and presented a summary to the grand jury which resulted in the grand jury returning a "No Bill" and dismissing the case., 2020
• Dustan represented a client that was charged with Assault of a Family Member where the alleged victim was making the accusation in an attempt to gain child custody in a family law matter. The criminal trial ended in a mistrial and the state chose to dismiss the case instead of trying it again, 2020
• Dustan tried a Federal Bench Trial in the Eastern District of Texas for allegations of a violation of Texas law on a National Seashore.  Dustan argued the facts of the case as applied to Texas law did not support the charged conduct as being unlawful.  The client was found Not Guilty., 2019
• Dustan tried a Sexual Assault case to jury verdict that resulted in a Not Guilty.  Through cross-examination of the alleged victim and other witness testimony, Dustan was able to show the truth to the jury that no crime occurred., 2019
• Dustan won a motion to suppress evidence hearing that resulted in a dismissal of a felony possession of a controlled substance case. The client was illegally arrested and was found to have a small amount of cocaine in his pocket when he was being booked in at the jail.  After the judge suppressed the evidence obtained after an illegal arrest, the state could not go forward on their case., 2019
• Dustan tried an assault case to a jury where the estranged spouse had made up a family violence allegation in an attempt to gain custody of the couple’s child.  the jury considered all the evidence and came back with a not guilty verdict in less than 10 minutes., 2019
• Dustan represented a man charged with money laundering over 10 million Dollars in federal court.  As he was accused, the client was facing up to 20 years in prison.  At the time of sentencing, the defendant had a guidelines sentencing range of 87 to 108 months.  After Dustan made arguments for a reduced sentence, the court handed down a sentence of 18 months., 2019
• Dustan represented a lady charged with delivery of a controlled substance and was facing 2 - 20 years in prison. After investigating the case and setting a motion to suppress evidence for a hearing, the state offered a reduced charge of misdemeanor possession of a controlled substance and set the punishment at a $300 fine, 2019
• Dustan represented a client charged with terroristic threat of a public servant (a state jail felony offense) where the client was accused to threatening to cause harm to a deputy sheriff.  After completing our investigation, we were able to show a grand jury that the officer was the instigator and the initial aggressor in the case.  The grand jury refused to indict the client and returned a no-bill., 2019
• Dustan tried a DWI case to a jury where the client was accused of driving while intoxicated with a blood alcohol level of .22 (almost 3 times the legal limit).  After cross-examining the arresting officer, the state decided to dismiss the case., 2019
• Dustan tried a 4 count sexual assault case to a jury over a two week period that resulted in the defendant being found not guilty and was exonerated of all the charges., 2018

• American Chemical Society - Forensic DUID Analysis Course – This course consisted of 40 hours of hands on training in the use of gas chromatography and mass spectrometry to conduct blood analysis to determine if a person is under the influence of drugs.  The course teaches how to maintain the instruments, how to use the instruments, how prepare testing samples, and how to interpret the analysis results, 2015
• American Chemical Society - Forensic Drug Analysis Course – This course taught the principals of solid drug analysis which uses different scientific methods to identify the drug substance and quantify the purity of the drug substance, 2014
