• Hundreds of convictions in the United States today arise from honest mistakes. However, thousands more are the result of government attorneys engaging in professional misconduct. Throughout society, there is an increasing trend of attorneys losing sight of the ethical expectations and duties inherent in the legal profession. While many attorneys begin their careers with the noble goal of seeking justice and serving the public, over time, these goals are often compromised. The desire to secure victories, maintain professional relationships, or advance personal interests gradually overshadows the commitment to justice. This unconscious shift in priorities, fueled by industry norms and employer policies, leads to a systemic breakdown where attorneys no longer fulfill their obligations under the law. Instead, they wield their authority to protect their own interests, contributing to a culture of corruption and political maneuvering. Left unchecked, such behavior erodes public trust and undermines the fundamental principles of fairness and justice. This white paper will examine several key areas. First, it will provide a foundation by discussing the ethical rules and policies designed to guide attorneys. Next, it will explore the motivations behind why government attorneys engage in misconduct, including factors such as reputation, personal wealth, and moral character. Finally, the paper will propose potential policy reforms aimed at mitigating the risk of such unethical behavior. The findings in this white paper are intended to provoke thought and encourage further research into the disturbing trend of government misconduct.
