Michael Hawash is a veteran trial lawyer who also serves as a mediator, arbitrator and early dispute resolution professional. Over a career that spans three decades, Michael has represented both plaintiffs and defendants in a variety of disputes, including those arising out of insurance coverage, insurance bad faith, professional malpractice, breach of contract, deceptive trade practices and other high-stakes business disputes. In addition to traditional court cases, Michael also handles arbitrations brought under the American Arbitration Association (AAA), Judicial Arbitration & Mediation Services (JAMS) and International Chamber of Commerce (ICC) rules.

As a certified mediator, Michael can serve as a neutral in both traditional and dynamic mediation, as well as an early dispute resolution professional using the protocols of the EDR Institute.

When not practicing law, Mr. Hawash indulges his passion for military history by visiting and exploring great battlefields all over the world.

Articles about Michael Hawash appearing in Super Lawyers

White Papers

  • An Introduction to Early Dispute Resolution (2020) - In traditional litigation, settlement typically comes only after lawyers engage in months or years of adversarial posturing that escalates the original conflict, deteriorates the relationship of the parties, and costs an ever-increasing amount of time and money.  Early Dispute Resolution (or EDR) seeks to short-circuit the traditional litigation model and provide parties with methods, optimally using the services of a trained neutral, to resolve almost all disputes within 30-60 days at a fraction of the cost.  Further, the parties should reach roughly the same resolution they would have reached after protracted discovery and motion practice.

Scholarly Lectures/Writings

  • Mediation is by far the most predominant method of alternative dispute resolution (ADR). In many courts, mediation is a prerequisite for getting to trial, especially when a jury is requested. But as mediation has become more ubiquitous, the rules and ethical standards for mediators have also grown. Even so, less attention has been paid to the standards of professionalism that lawyers representing clients in mediation should follow, which is a shame as clients would be far better served if lawyers had a better understanding of professionalism in mediation as well as in the courtroom. The basic ethical duties owed by a lawyer engaged in mediation can be distilled to these five: keeping a client informed about their case, including settlement and ADR options; competent representation before and during the mediation; avoidance of conflicts of interest; protecting confidentiality; and the avoidance of the unauthorized practice of law.
