White Papers:
  • The Ellerth and Faragher decisions are two landmark cases relating to workplace harassment. Both the cases are usually considered alongside as they resulted in a reliable test for determining the employer's liability in cases of harassment alleged by an employee against a supervisor.  BUT, more than 20 years later, federal and state courts are still struggling with the application of this decision in today’s cases. The Faragher-Ellerth Doctrine is generally recognized as a defense against harassment claims under Title VII of the Civil Rights Act of 1964 (Title VII) and by the equivalent law of many states. It is primarily used to defend against claims of sexual harassment, but has also been applied to defend against claims of hostile work environment harassment on the basis of other protected classes. Only applies to supervisor harassment claims, as harassment by co-workers is examined under a completely different standard.  Prior to this Doctrine, federal courts generally followed the “quid pro quo” and “hostile environment” distinctions in Title VII litigation. Before Ellerth and Faragher, an employer could avoid liability in many cases "if it adequately investigated and took prompt and appropriate remedial action upon notice of the alleged hostile work environment.  Courts continue to struggle as they interpret the opinions in these two seminole cases, Affirmative Defenses: "Who Fumbled The Faragher/Ellerth Defenses, Employment Law, 2022
