Richard L. Spencer

Richard L. Spencer, a key figure at Ferguson Braswell Fraser Kubasta PC in Houston, Texas, with branches in Plano, Austin, and Irvine, California, has a rich history of representing a diverse array of clients in areas such as contracts, commercial transactions, complex financings, securities fraud, corporate dealings, and both stock and asset acquisitions. His skill extends to working with commercial and residential real estate stakeholders, including owners, associations, developers and lenders, tackling issues from loans and construction matters to foreclosures, title disputes and zoning concerns.

A Licensed real estate broker in Texas, Mr. Spencer holds a triple-board certification in commercial and residential real estate law, and Power of Attorney law from the Texas Board of Legal Specialization (TBLS) and has served on the TBLS Real Estate Law Advisory Commission. He frequently acts as a witness and advisor on various legal, ethical, and business issues and has successfully drafted and passed legislation in the Texas Legislature. As a speaker and writer, he regularly shares insights on real estate topics.

An alumnus of The University of Texas at Austin, Mr. Spencer holds a B.B.A. (1975) in finance and accounting and an M.B.A. (1976) with a focus on the same fields from the McCombs School of Business. His academic contributions include authoring "Accounting and Financial Problems and Procedures of a Brazilian Multinational Firm." He also earned his J.D. (1981) from the University of Houston Law Center, where he wrote "Commerce v. Consumer, a Texas Position on Due-On-Sale Clauses."

Admitted to practice in Texas since 1981, Mr. Spencer is qualified to appear before the United States District Courts for the Northern and Southern Districts of Texas, the United States Courts of Appeals for the 5th Circuit and the United States Supreme Court. He is a fellow of the American College of Real Estate Lawyers and a director of the Texas Bar College. He has chaired prominent sections of the State Bar of Texas and the Texas College of Real Estate Attorneys and led the Texas Real Estate Forms Committee.

Significantly, Mr. Spencer was instrumental in shaping the Texas Assignment of Rents Act. As a distinguished life fellow of the Texas Bar Foundation, he is celebrated for his contributions as a course director, writer and speaker at advanced real estate law seminars. He also holds the esteemed title of master within the American Inns of Court.
