  • In Re: Azurix Securities Litigation.
  • Moran (Creditor's Trust Litigation) vs Brian Pardo; Represented Brian Pardo, former Chairman and CEO of Life Partners in litigation jointly brought by Life Partners' Bankruptcy Trustee and 22,000 Investors who purchased fractional interests in billions of dollars of Life Insurance Policies brokered by Life Partners. Plaintiffs' claims included securities fraud, ponzi scheme, breach of fiduciary duty, fraudulent transfer and bankruptcy preferences. Notably, before Burford Perry, LLP was engaged Pardo had already lost a case for Securities Fraud brought by the Securities and Exchange Commission related to the sale of these very same fractional interests, and to make matters worse the fractional interest sold by Life Partners was found to be a "security" by the the Texas Supreme Court (and therefore subject to securities regulations. Against this backdrop, the Plaintiffs sought approximately $750 million in damages, boldly claiming in numerous press articles, trade journals and at trial that Pardo had orchestrated the biggest Ponzi Scheme in Texas history.  After a contentious jury trial before the Honorable Reed O'Connor, in which the jury soundly rejected the Plaintiffs claims of Ponzi Scheme---and the Court ultimately entered a judgment for only $24 million which was less than 3% of Plaintiffs' claimed damages.
