Admitted to practice in the state of Texas, Mr. Wilson is also admitted to practice in several federal courts. No. 4:21-cv-0618, 2023 WL 2433977, This Fair Labor Standards Act (FLSA) case is before the Court on Plaintiffs’ Motion for Partial Summary Judgment Against Milstead Automotive, Ltd. ECF 48. Having considered the parties’ submissions, argument of counsel at a hearing on the record on October 7, 2022, and the law, the Court GRANTS the Motion in part and orders the parties to submit a proposed date for trial of the remaining issues. Court granted our motion to preclude defendants' 207(i) retail service exemption because defendants could not show that they meet the revenue test required to pay tow operators a commission wage without overtime. Plaintiffs also showed that the employer paid the plaintiffs less than the required $10.88 an hour and sometimes less than the minimum wage for over 60 hours of work in a workweek. Defendants also failed to show that its violations were in good faith. Therefore, liquidated damages were applied. The court held Defendants' willfulness and total damages for trial. , 2023
