Verdicts/Settlements:

  • On behalf of clients Brown & Brown, Inc. and its Houston subsidiary, went to trial with Ricardo Cedillo & Rick Espey defending complex litigation brought by Great American Insurance Company. Great American alleged it had paid millions of dollars in false claims because the Houston subsidiary created fraudulent Great American insurance policies which were sent to dozens of clients, and Brown & Brown, Inc. tried to cover it up. Great American sought to recover at least $97 million, alleging multiple causes of action including violations of RICO, violations of federal trademark and state insurance laws, fraud, breach of fiduciary duty, negligence and breach of contract. Great American incurred approximately $20 million in attorney fees and expenses prosecuting the case. During the course of the litigation over 115 witnesses were deposed, including 35 expert witnesses, and millions of pages of documents were produced. During the trial, the court dismissed the RICO claim against our clients and granted a directed verdict in favor of Brown & Brown, Inc. on all pending claims. The Harris County jury ultimately awarded only a small fraction of what Great American spent on attorney fees and expenses., 2008
  • As lead counsel, on behalf of an individual, brought a breach of contract claim against his employer (RadCare). Went to trial and obtained a jury verdict against RadCare for the entire $154,800 sought. Also obtained an award of $181,847.38 for attorney's fees., 2012
  • As lead counsel, on behalf of an individual, defended a garnishment action brought against him by a debt collection company (The Cadle Company).  Prevailed and defended the result all the way throgh the Texas Supreme Court.  Then pursued a claim in Bexar County District Court for wrongful garnishment, fraud, and breach of contract against The Cadle Company.  Went to trial and obtained a jury verdict against The Cadle Company on all three causes of action and an Judgment for over $275,000., 2009
  • As lead counsel, went to trial on behalf AT&T bringing claims a railroad (CSX) for negligence and breach of contract.  An arbitrator found in favor of AT&T and awarded damages to AT&T consistent therewith., 2015
  • Went to trial on behalf of our client, Perry Homes, against a consumer alleging violations of the Deceptive Trade Practice Act.  After a one-week trial the case was settled on terms very favorable to our client., 1999
  • On behalf of Mr. & Mrs. Jones, went to trial with Will Allan and Alex Nava on an action against State Farm for violations of the Insurance Code, bad faith, breach of contract, and to set aside an Appraisal Award.  The lawsuit related to an insurance claim for storm damage to the Jones' home that State Farm assessed at $535.25.  The jury found for the Jones on all counts and awarded $80,000 in actual damages, $50,000 in punitive damages, and over $300,000 in attorneys fees through the appeal.  With interests and costs the Court entered a Judgment for almost $500,000., 2017
  • As lead counsel, went to trial on behalf of our client, Gillespie Ford, bringing a claim against a wholesaler for breach of contract.  After a one-week trial the jury awarded our client every penny of damages sought., 2003
  • On behalf of our client, General Electric Capital Business Asset Funding Corporation, went to trial with Ricardo Cedillo against S.A.S.E. Military Ltd., Vanderburg Investments, Inc., and John Q. Vanderburg in the United States District Court, Western District of Texas, claiming unpaid interest and principal as well as damages for unpaid taxes, fees, and maintenance costs, as well as its attorneys' fees. After a four-week trial, the jury awarded our clients $13,936,094 in compensatory damages., 2004
  • As lead counsel, went to trial on behalf of an individual bringing a claim against a construction company that renovated her home. After a two-week trial the jury found violations of the Texas Deceptive Trace Practices Act., 2011
  • As lead counsel, went to trial on behalf AT&T bringing claims a construction company (SJ Louis) for negligence and violations of the Texas Utilities Code.  A jury returned a verdict in favor of AT&T on all counts., 2014
  • Went to trial on behalf of our client, Barrett Motors, against a consumer alleging violations of the Deceptive Trade Practice Act.  A jury returned a take-nothing verdict in favor of our client., 1999
  • As lead counsel, went to trial (it was a bench trial) on behalf of AT&T bringing claims that an excavator (Jackson Utilities) damaged AT&T while excavating in violation of the Montana Dig Law.  The judge found that the excavation was in violation of the Montana Dig Law and awarded damages to AT&T consistent therewith.   , 2016
  • Went to trial on behalf of our client, North Park Lincoln-Mercury, against a consumer alleging violations of the Deceptive Trade Practice Act.  A jury returned a take-nothing verdict in favor of our client., 2001
  • Went to trial with Ricardo Cedillo defending claims brought by one of DuPont's former distributors. The Plaintiff sought over $1 billion in damages for antitrust violations. After one week of trial in Austin, Texas, the case settled with the Plaintiff paying money to our client., 2003
  • On behalf of CPS Energy, went to trial with Ricardo Cedillo on an action for a declaratory judgment over whether CPS Energy would retain its 50% ownership interest in an a project to develop two nuclear reactors.  The project's was recently appraised at around $3 Billion and the defendants claimed that CPS Energy would lose all interest int he project in the event of withdrawal.  The parties agreed to conduct discovery and go to trial in 20 days.  During that time we 1) responded to discovery in seven days (including the review of over a million pages of records and production of over 700,000 pages), 2) successfully defended several motions for continuance, 3) successfully defended a plea in intervention, 4) successfully overcame three removals to federal court, 5) took and defended about two dozen depositions, and 5) defeated a motion for summary judgment.  At trial we obtained declarations on all issues in favor of CPS Energy. , 2010
  • As lead counsel, went to trial on behalf of our client, Grande Truck Sales, Inc., against a consumer alleging negligence and violations of the Deceptive Trade Practice Act.  A jury returned a take-nothing verdict in favor of our client., 2013
