Zachary Kitts is a partner at K&G Law Group, PLLC, where he concentrates his practice in the areas of qui tam litigation, employment law, business torts, and other complex civil litigation matters.  In his qui tam practice, Zach exclusively represents relators (or whistleblowers as they are sometimes called). He has prosecuted a wide variety of qui tam claims in state and federal courts across the country against health care providers, defense contractors, financial institutions and others. To date, his cases have returned more than $118 million to the public fisc, including a $20.7 million settlement that was the largest settlement in Virginia for 2018. 

Zach is widely recognized as a leading expert on state false claims act legislation; he has also testified before numerous state legislatures in favor of state false claims legislation.  He was the principal architect behind the comprehensive 2011 amendments to Virginia's version of the false claims act, known as the Virginia Fraud Against Taxpayers Act, (Va. Code §8.01-216.1 et seq.) He was also the first to bring a retaliation claim under the VFATA against a local government entity.  Until January of 2016 he held the record for the largest non-healthcare recovery under the VFATA.

In his employment law practice, Zach represents both employers and employees in a full range of matters including wrongful termination, wage and hour, non-competition agreements, discrimination and retaliation, and other causes of action.  He received his undergraduate degree from George Mason University and his law degree from American University's Washington College of Law.  Prior to entering private practice, Zach was a law clerk to Maryland Circuit Court Judge John Hanson Briscoe. 

Zach is active in numerous bar groups and is a regular speaker at Continuing Legal Education courses throughout the Commonwealth, including several programs that have been picked up for national syndication.  He is currently on the faculty of Virginia's Harry Carrico Professionalism Course, which is mandatory for all new Virginia lawyers; Zach also serves on the Virginia State Bar's Standing Committee on Professionalism.

  • United States ex rel. Christine Duncan v. LS Technologies, et al., 2007 WL 4896185 (2007). Successfully prosecuted a non-intervened Federal False Claims Act case; became one of very few qui tam lawyers to have the Department of Justice award a client the statutory maximum of 30% of the government’s recovery. 
  • ESTES FORWARDING WORLDWIDE LLC v. Marcelo S. CUELLAR, 239 F.Supp.3d 918 (E.D.Va. 2017)
  • Obtained a precedent-setting jury verdict in March of 2013 under Virginia Fraud Against Taxpayers Act in Lewis v. City of Alexandria.  This was the first anti-retaliation case brought under the newly-amended VFATA retaliation provisions.
  • Obtained the second-largest settlement in Virginia in 2012 in the amount of $18.1 million.
