Before founding Merrick Brock, John spent over a decade defending insurance companies. Over time, he grew frustrated with their tactics—manipulating cases, undermining claims, and offering far less than victims deserved. He decided to use his insider knowledge to fight back, representing clients who had been injured by negligence, harmful products, or neglect throughout Virginia.

John has tried numerous cases across courts throughout the Commonwealth, handled multiple appeals, and successfully argued before the Virginia Supreme Court. He thrives on pushing himself outside of his comfort zone and embraces new challenges.

John’s extensive experience includes personal injury cases like product and premises liability, nursing home neglect, dog bites, and truck and auto accidents. He also has expertise in commercial disputes involving consumer fraud, defamation, breach of contract, construction disputes, and property issues.

John Merrick’s path to becoming a trial lawyer wasn’t a straight one. In fact, his early ambition was to become a charter-fishing boat captain. However, he quickly discovered that a career in law, particularly litigation, allowed him to help others while feeding his competitive drive.

A graduate of Sewanee – The University of the South. John worked as a professional mate on sport-fishing boats in the Atlantic, Pacific, and Gulf of Mexico before attending law school at the University of Richmond. He also spent time working in restaurants in Idaho while pursuing his passion for trout fishing and waterfowl hunting.

For John, being a lawyer is central to his identity and lifelong growth. His love for the outdoors, particularly hunting and fishing, is also a key part of who he is. While he still dreams of one day owning a charter boat, for now, he finds great joy in taking his young son out on the water to catch blue crabs and small fish.

Verdicts / Settlements (Case Results)

  • $1,250,000.00 settlement. The decedent was tragically killed by another driver in a head on collision that occurred around 8:20 p.m. on Parham Road in Henrico Co. The decedent was driving home from the gym when the defendant lost control of his vehicle, crossed the center line, and crashed into decedent’s vehicle. The defendant claimed that he experienced a “sudden emergency” which caused him to blackout. The defendant’s insurance company relied on this defense, and did not make a settlement offer. We filed suit, conducted discovery and performed an extensive investigation. Shortly after the deposition of the defendant, during which John Merrick poked holes in the defendant’s sudden emergency claim, we made a time sensitive demand for all available insurance coverage. The insurance company responded by offering the entire amount of insurance coverage., 2025
  • $1,000,000.00 settlement in auto accident case with disputed liability and damages. Additional details confidential. , 2025
  • $900,000.00 Jury Verdict. The plaintiff, a 47-year-old auto mechanic, was rear-ended while stopped in traffic waiting to make a left turn. There was minor physical damage to the plaintiff’s rear bumper and the plaintiff reportedly denied any injury at the scene. The plaintiff later sought treatment for radiating low back pain and was initially diagnosed with strains and sprains, but about a month later when his symptoms worsened, he was diagnosed with a herniated disc at L5-S1.After conservative treatment failed, the plaintiff underwent an anterior lumbar interbody fusion with posterior instrumentation at L5-S1. Liability was clear, but damages were strongly contested. The plaintiff had a physically demanding job and had a history of prior back issues, including a herniated disc at the same level 20 years earlier and a compression fracture at another level, and he had treated for low back pain on several occasions in the years before the accident. The defense focused heavily on the plaintiff’s prior back issues as the source of his ongoing back complaints and argued that the slight disc protrusion noted on the MRI was the result of an unrelated degenerative condition called disc osteophyte complex. The defense medical experts testified that the MRI showed a dark disc with osteophytes, which takes years to develop and would have predated the accident. The plaintiff’s treating surgeon testified that the plaintiff suffered an acute disc extrusion in the accident, which was a new injury that caused nerve root compression and necessitated surgical intervention to address the plaintiff’s radicular complaints. A four-day jury trial resulted in a verdict for the plaintiff in the amount of $900,000., 2023
  • $1,050,000.00 Wrongful Death Settlement. This case involved numerous legal challenges and required extensive coordination across multiple jurisdictions. The decedent, a front-seat passenger in a Ford F-150 work truck owned by his employer, was fatally injured in a serious motor vehicle collision. The crash occurred when the defendant failed to yield the right of way at an intersection, causing the decedent’s vehicle to t-bone the defendant. He suffered blunt force trauma and tragically passed away from his injuries several days later. The case was referred to John Merrick shortly after the initial suit was filed. At that time, the only settlement offer on the table was $50,000, and the case involved a number of complicating factors, including an Ohio Workers' Compensation lien in excess of $1 million, a surviving spouse by common law marriage residing out of state, an estranged out-of-state beneficiary, and out of state insurance policies with underinsured motorist coverage. Despite these complexities, counsel worked diligently to maximize the recovery for the estate. This included negotiating a significant reduction of the workers’ compensation lien, identifying and securing the full extent of available insurance coverage, and facilitating a collaborative resolution among all interested beneficiaries. The lawsuit was filed on February 18, 2025. After months of strategic litigation and negotiations, the Court approved the final settlement on July 23, 2025. This case highlights the importance of experienced legal advocacy in navigating multifaceted wrongful death claims—especially those involving overlapping jurisdictions, complicated lien issues, and sensitive family dynamics., 2025
