  • The following are some of Ms. Bertram’s settlements and verdicts:  Jury award of $8M in DC Superior Court in September 2017 in a medical malpractice case. There was no offer before trial. Highest jury award in a medical malpractice case in DC Superior Court in 10 years. A recent settlement against the District of Columbia for allowing a high school student at Wilson to be assaulted by another student who had already assaulted another student and threatened a teacher, yet they left him in the school unsupervised.  A $4.3 million confidential settlement for a child who suffered severe brain damage, seizures and cerebral palsy following his delivery at a hospital in the Maryland suburbs. This settlement is very significant in light of Maryland’s arbitrary and wholly insufficient cap on pain and suffering.  A $4 million settlement for patient who suffered a stroke due to improper technique during a surgery. Another local case with a confidential settlement of $2.8 million for mother who was brain damaged after childbirth. Two tragic cases involved large confidential settlements for the wrongful death of infants in the DC area due to an unsafe medical product. A $2.7 million confidential settlement for a patient and his family against a local hospital after it was determined that the hospital did not have defibrillator paddles in their operating room when the patient was taken to the operating room for an exploratory procedure after his open-heart surgery. As a result, the patient’s heart stopped beating and his brain was deprived of oxygen for an extended period.  He sustained significant brain damage and remained in a coma, never able to communicate again with his wife and six year old daughter. A $2.8 million confidential settlement for a wife and her children after their father died when the hospital failed to diagnose his stroke symptoms in the emergency department. A $750,000 confidential settlement for a local man who suffered a stroke during a simple cervical surgery at a local area hospital. Another confidential $750,000 settlement for a local man who was subjected to unnecessary radiation to his bladder due to the negligence of his physicians. A confidential settlement against a local hospital who allowed a surgeon to operate at their hospital who was no longer safe to operate. A confidential settlement for the parents of a newly born infant who died in the hospital right after birth when he was given a deadly dose of medication that was mixed improperly by the pharmacy and the error was not caught by the hospital staff. A confidential settlement for a cancer patient against a local hospital when they punctured his bowel while inserting a medical device and then failed to detect the error resulting in severe pain and suffering for the patient during these final months of life
