Mr. McKenna is a recognized leader in construction law in the Washington Metropolitan region.  In the specialized field of construction defect litigation, he has recovered over $27 million dollars in damages for his commercial owner and developer clients, which include some of the country's largest.  Mr. McKenna has also secured numerous defense verdicts for contractor and builder clients facing multiple millions of dollars in exposure.   He has successfully represented clients both regionally and nationally  in disputes involving delay damages, mechanic's liens, mold litigation (including successfully defending against personal injury claims), condominum warranty litigation, fraud claims, products' liability, professional negligence, hazardous materials litigation, and commercial general liability insurance disputes. 

Mr. McKenna also regularly represents and counsels clients on devising and implementing customized and project-specific alternative dispute resolution plans of action, with a particular focus on early and expeditious resolution of budding disputes through effective project close-out strategies and/or mediation. 

Mr. McKenna uses his experience as a litigator to provide "real world" risk avoidance and mitigation advice to his clients at the beginning stages of a project, and to develop custom form construction contracts tailored to his clients' business plans and project needs.  He has developed and negotiated an array of different construction contracts, for standard "owner-contractor-architect"projects as well as for design-build and design-assist projects.  His clients regularly draw from his extensive contracts' form library, for projects across the United States of all different types, including multi-family, mixed use, condominium, hotel and hospitality, retail, time share and industrial.  He has also assisted his clients on Americans with Disabilities Act ("ADA") issues, in connection with due diligence and compliance efforts.

 Mr. McKenna is a graduate the Columbia School of Law, Catholic University, Washington D.C. He is member of the Bars of the District of Columbia and Maryland as well as the United States District Court for the District of Maryland, and served as law clerk to the Honorable Thomas A. Flannery, US District Court, District of Columbia, from 1992–1994. He is a member of the National Association of Home Builder's ("NAHB’s") Construction Law Attorney Forum, a select group of attorneys from across the country chosen by the NAHB for their recognized experience representing builders, as well as the Washington Building Congress, DCBIA and the Barristers.  He has lectured both regionally and nationally on matters such as construction defects, mold, and condominium liability exposures. He has authored numerous articles on construction law, including an analysis of the 2009 Federal Stimulus Act’s impact on green building activity for the web publication Green Space Today.
