Josh’s practice focuses on white-collar criminal defense and civil litigation across the nation. In the white-collar realm, Josh has represented individuals and businesses facing government investigations and indictments, as well as people previously found guilty. In many of these matters, Josh defended health care providers or executives against potential or actual charges for allegedly committing health care fraud, violating the Anti-Kickback Statute, and/or related offenses. These matters have involved retail, specialty, and compounding pharmacies; various types of medical practices (from traditional doctor’s offices to clinics to telemedicine); lab tests; durable medical equipment; and government contracts. The accusations have related to payments by government programs (such as Medicare, Medicaid, and Tricare) and by private insurance companies. Additional white-collar matters that Josh has handled involved accusations of public corruption, such as bribing government officials, defrauding federal programs, and violating campaign finance laws, and/or other financial crimes not involving the health care industry.
In February 2025, a victory by Josh and his co-counsel in a purported $3M health care fraud case was the lead story in Law360’s White Collar Crime publication. The team persuaded a federal judge to dismiss all of the charges against their client with prejudice weeks before his trial was to begin. In another health care fraud case where Josh won a dismissal with prejudice, he began representing the client after a jury found him guilty, with sentencing weeks away. Without filing an appeal, Josh persuaded the same judge who presided over the trial to grant a new trial based on the government presenting false evidence and ultimately to dismiss the case with prejudice based on egregious government misconduct just before the second trial. NPR reported on this triumph – an astonishing turnaround that no other attorney in the U.S. has achieved – during All Things Considered and published a digital story with more information about it. A leading practitioner and commentator on white-collar criminal defense called Josh’s advocacy in that case “relentless” and “particularly brilliant.” Josh’s successes also include defeating the government at trials in cases where an elected official was charged with fraud and bribery and the owner of a direct marketing company was charged with violating campaign finance laws.
In the civil arena, presently and for the past several years, most of Josh’s work has entailed seeking remedies for individuals and businesses of various sizes in a wide array of sensitive matters involving economic injuries in the millions of dollars from fraud or other misconduct. Josh is the first and only attorney in the nation to successfully bring federal civil RICO claims arising out of the purchase of a pharmacy. He has now brought such claims in multiple jurisdictions. Some of his more notable wins have involved obtaining favorable resolutions, without publicity, that remain confidential. A recent example is a pre-litigation settlement recovering the entire amount (over $5M) that a sham promoter of the employee retention credit (a legitimate COVID-era tax benefit commonly known as the ERC) fraudulently induced a mid-sized company to pay. Another recent example is a pre-litigation settlement resulting in millions being paid to a small business in connection with its role in the 340B Program.
Some of Josh’s current or recent clients include victims of schemes to fraudulently obtain or misappropriate large sums of money (such as those mentioned above); persons and entities who were defrauded into buying pharmacies and into getting bank loans of several million dollars to do so; a pharmacist and entrepreneur whose successful chain of retail and specialty pharmacies was illegally destroyed by government agents; health care providers for whom Josh provides compliance advice; health care providers who retained Josh to conduct an internal investigation; a government official charged for alleged public corruption and money laundering offenses; and a former government employee who pled guilty to a tax offense.
After graduating with honors from Stanford Law School, Josh clerked for Judge Thomas L. Ambro on the U.S. Court of Appeals for the Third Circuit and practiced in the D.C. offices of Covington & Burling and Womble Carlyle. Josh is a member of the Edward Bennett Williams American Inn of Court, an invitation-only professional organization in Washington, D.C. devoted to white-collar criminal practice.
