- $5,750,000.00 Settlement A woman was commuting on her electric bike. While stopped for a red light, a cement truck turned into her lane, knocked her over, and drove over her left leg. The driver of the cement truck then reversed and drove over her leg a second time. As a result, the woman suffered a severe crushing injury of her left foot and ankle with multiple fractures. She was admitted to the hospital for emergency surgery, which was the first of what would be five surgeries. There were complications with her big toe, and ultimately, it had to be amputated. She also developed hammer toe, and delayed union at her metatarsal. Further, she suffered from significant nerve pain and was diagnosed with chronic regional pain syndrome. , 2023
- $150,000.00 Our client was simply entering her home when she slipped and fell on the ramp leading to her apartment door. The ramp was constructed of plywood, which was partially covered in roofing shingles. Where there was exposed wood, paint was chipping off and it was covered in mold and mildew – this was not maintained, extremely slippery, and not constructed even close to code. Our client’s fall caused an egregious injury – she suffered right ankle syndesmotic disruption and lateral malleolus fracture, which required open reduction and internal fixation of the lateral malleolus and repair of syndesmosis. In other words, this surgery required plates and screws, as well as a suture rope device running through a hole in her ankle due to gross disruption of her ligament. The apartment complex felt that our client failed to use ordinary care and was the cause of her fall. They were not accepting liability but made a compromise offer of $15,000 in exchange for a release. Her prior attorney was not willing to invest in the case and instead said they would withdraw representation and allow her to collect the $15,000 that was on the table. As soon as Kode Law Firm was retained, an engineer and human factors expert were hired to help us understand the construction code as it related to ramps and “way-finding” – a term used to describe the mental load, visual processing, and behaviors of a person navigating from one point to another. Armed with this information, we renewed negotiations and settled the case for $150,000. Our client felt abandoned, and we were able to provide her with the advocacy and compensation she deserved., 2019
- $175,000.00 Our client was working as a rideshare driver when he was rear-ended at a high rate of speed and pushed into the vehicle in front of him. The fire department had to cut the vehicle to extricate him, and he was found coming back to consciousness but unable to form sentences and had vomited. He was taken to the hospital suffering blunt chest and abdominal trauma, confusion, and right shoulder pain. After his discharge, he was still experiencing an extraordinary amount of pain, including in his right ankle, knee, hip, and forearm, in his lower back up to his mid-back and neck. He also had pain in his sternum. The most acute location of pain was in his back, which would also spasm. Our client was also experiencing headaches radiating from his neck to behind his eyes, as well as memory and balance issues. Lastly, he was suffering severe diffuse back pain that was radiating to his abdomen and felt like he was having spasms in his diaphragm causing difficulty breathing. These spasms were triggered by driving and bumps in the road, impacting his ability to work. Unfortunately, while unrepresented, our client agreed to settle with the at-fault driver for a nominal amount far less than the policy limit, but we were able to secure an additional $175,000 from his own policy under his underinsured motorist coverage. , 2022
- $900,000.00 Pharmacy filled a prescription bottle with pills that were double the dosage of the usual-sized pills, but the instructions on how many pills to take stayed the same. This resulted in our client taking double the dosage of the drug than prescribed. Gradually, he started exhibiting unusual behavior and altered mental state, including agitation, anxiety, anger, and confusion. He was taken to the hospital where blood results confirmed he had toxic levels of the drug in his blood, and the error was discovered. Due to his altered mental state, our client had to be restrained to his hospital bed which he fought against, injuring his shoulders including labral and rotator cuff tears. He underwent several surgeries on both of his shoulders. , 2023
- $1,100,000.00 A young woman in her twenties, was called into work early and had to catch a Lyft rideshare instead of taking the bus as usual. She recalled dozing off while looking at her phone and the next thing she could remember was the Lyft driver’s seat being shoved back into her, and the driver was having a seizure. Our client had pain in her jaw and mouth, which was bleeding, and she had broken teeth. The Lyft vehicle had been driving on the freeway and was rear-ended at a high rate of speed, causing them to be pushed into another vehicle ahead. The Lyft vehicle was smashed front and back and completely mangled. Our client suffered post-traumatic stress over the trauma of the collision and the condition of the driver, who had to be extricated while she sat there with him practically in her lap. She was then taken to the hospital where it was determined she suffered from mandibular fractures and malalignment of her teeth. Surgery was required after which her mouth was wired shut, necessitating feeding through a tube for six weeks and keeping emergency wire cutters nearby in case she needed to vomit to prevent choking. Once her jaw healed, she found that she had lost her sense of smell and taste. After consultation with a neurologist and an MRI scan of her brain, it was determined that she had injured her olfactory nerve and there was a possibility this would never fully return., 2021
