  • City v. E.R..: Client hits parked vehicle on the side of road.  Rather than fleeing scene, client remains at location. Upon officer arrival, admission to drinking, poor performance on Field Sobreity Tests, etc...  Prior alcohol-related history. Client is business professional with a great deal to lose if matter isn't resolved in an extremely favorable light.  After investigation and extensive negotiation, the charge was eventually amended to Negligent Driving in the First Degree, no jail, no license suspension, etc..  Further, we were also able to avoid the separate administration action against client's driving privilege.  There were several things that stand about this case: (1.) The matter occurred in a jurisdiction for which the prosecutor does not like to negotiates cases. Rather, the vast majority of defense attorneys in this court end up entering Guilty pleas (as charged) to DUI. In cases for which my clients and I don't receive offers that we are happy with, I routinely recommend proceeding to trial.  As a result, I occasionally get my teeth kicked in at trial.  That said, I believe such plays a SIGNIFICANT part in why my clients end up with far better resolutions than other attorneys. (2.) As mentioned, my client had a LOT to lose from an employment and personal perspective. A conviction for DUI &/or time in jail would have resulted in client's future being altered.  I work just as hard for everyone of my clients.  However, I'd be lying if I said I didn't worry even more about clients who were likely to lose employment in the event matters weren't resolved favorably.  I spent a considerable amount of time on this case and believe the matter would not have resolved anywhere near the way it did had I not taken the tactful approach that I did.  Just as in any type of negotiation, it's important to understand the person you are dealing with and what motivates them.  This matter stands out as one for which I am very proud of.    we appeared to enter a resolution, one of the State's law enforcement officer witnesses showed.  Upon being told by the prosecutor that the case was resolving in the manner that it was, the officer was visibly upset. This officer is actually some that I respect significantly.  He is an absolute straight-shooter and is as ethical of a person as I have ever met. In my opinion, he is the most knowledgable DUI officer in the state and he does his job the right way.  It is for this reason that prosecutors often opt to not negotiate cases for which he's the investigating officer.  Reaching this resolution for my client stands out to me because I believe I was able to get to a place other attorneys wouldn't have gotten. , 2020
