  • Tens of thousands of elderly and disabled Washingtonians live in long-term care facilities. These facilities provide housing and varying levels of care and supervision to their residents. The primary types of long-term care facilities are nursing homes, adult family homes, and assisted living facilities. In recent years, the percentage of the elderly living in the traditional nursing home setting has decreased as individuals and the State move toward the more cost-effective adult family homes and assisted living facilities.  The focus of this article is on personal injury claims against adult family homes and assisted living facilities. The rapid growth in these facilities has led to a corresponding rise in litigation involving them. In litigating such cases, it is critical that attorneys understand the claims that are available to them and the tools they have to prosecute these claims. The article briefly outlines the statutory and regulatory frameworks that apply to claims against adult family homes and assisted living facilities, and provide some practice tips on how to effectively pursue such claims., Co-Author, The Rise of Alternative Long-Term Care Facilities; What plaintiffs’ lawyers need to know, Trial News (WSAJ), 2019
