  • Al Foeckler, a prominent Wisconsin trial lawyer, joins Dan Ambrose to discuss his remarkable journey from the Wisconsin Supreme Court to becoming one of the state's top plaintiff attorneys. With over 27 years of experience, Al shares insights from his career-defining $39 million O'Donnell Park case and his philosophy on "Black Hat Justice." "It's easy to convince yourself to settle a case," Al says. "But if you're not taking cases to trial, you're doing a disservice to your clients." Listen as Al discusses the importance of continuous learning, networking with fellow trial lawyers, and having the courage to take cases to verdict. Episode Snapshot Al began his legal career with a clerkship at the Wisconsin Supreme Court before transitioning to corporate litigation at a large Milwaukee firm. In 2004, Al ran for State Assembly, which connected him with trial lawyers who would later become his colleagues and mentors. After a brief stint in asbestos defense work, Al joined Cannon & Dunphy, where he's been for over 20 years. Al describes the challenging "Statute of Repose" legal issue that nearly derailed the case, and how his team overcame it. Al discusses his "Black Hat Justice" philosophy: identifying and exposing wrongdoers while maintaining your credibility as a "white hat." Al credits TLU with inspiring him and connecting him with a network of trial lawyers who continue to help each other. Al emphasizes the importance of drawing lines in the sand with insurance companies and being willing to take cases to trial. Al and Dan discuss upcoming TLU events, including Huntington Beach (June 4-7) and upcoming webinars on the O'Donnell Park case (April 7) and Black Hat Justice (May 5)., Al Foeckler – From Wisconsin State Supreme Court to Wisconsin's Top Trial Lawyer, Legal, 2025
  • In this episode of Best Practices with Kenny Berger, Kenny sits down with Wisconsin trial lawyer Al Foeckler to break down how big data shaped strategy, decision-making, and ultimately a $15 million verdict in a wrongful death case. Al walks through the real-time choices his team faced before and during trial, including whether to tell the jury the value of the case in opening, how data informed that decision, and why dropping certain claims actually increased the overall recovery. The conversation dives into credibility, preparation, and the discipline required to trust the numbers while still honoring the human story at the center of the case. This episode covers: -How big data influences case valuation and win rates -When and how to introduce large numbers to a jury -Using voir dire to frame value and burden of proof -Building credibility through preparation and follow-through -Structuring order of proof to create momentum and clarity -Turning complex facts into a story jurors can visualize and remember Throughout the discussion, Al emphasizes that big verdicts are not about bravado. They are about preparation, authenticity, and making strategic decisions grounded in evidence, data, and respect for the jury., Using Big Data to Drive Big Verdicts | Attorney Al Foeckler | Best Practices S6 Ep. 2, 2026
