  • This civil case concerned an intersection collision between two vehicles on July of 2014 in Eau Claire, Wisconsin.  A two-day jury trial was held in April 2017 on the issues of liability and damages. This was a turn-in-front collision, where the plaintiffs contended that the defendant made a left-turn without properly confirming that he could do so safely and that the defendant failed to yield to oncoming traffic. The physical evidence indicated that the defendant’s vehicle had struck the driver’s side of the plaintiff’s vehicle, which sent the plaintiff’s vehicle careening into a light pole adjacent to the road. Defendants contended that the defendant did yield to the oncoming plaintiff, though they admitted that his stop put him in the plaintiff’s lane. The defendants contended that the plaintiff was contributorily negligent in not avoiding the defendant’s vehicle. American Family Insurance Company insured the defendant. Injuries consisted of a fracture to a bone in the left hand, and injuries to the left shoulder that required two surgeries, a subacromial decompression and a later clavicular resection. The plaintiffs argued that the left shoulder injuries were permanent and there would likely be future medical expenses, including a future surgery.    Defendants argued that the left shoulder problems were degenerative in nature and not related to the collision, and offered the testimony of Dr. Paul Cederberg, who performed a medical evaluation of the plaintiff. Dr. Cederberg said all of the treatment for the left shoulder was appropriate and necessary, but that such physical complaints were caused not by the car accident but by a spontaneous flare-up of a previously dormant arthritic condition. Plaintiffs presented the evidence of the treating orthopedic surgery who cited the car crash as being the cause for the permanent left shoulder injuries. The court found as a matter of law that the defendant was negligent and that such negligence was a cause of the accident. The jury found that the plaintiff was not contributorily negligent, with one juror dissenting.   • Plaintiff lived and worked on his family’s dairy farm in rural Chetek, Wisconsin. On May 19, 2010, he was headed west on County Road D, in front of the farm, on the family’s John Deere 2840, which dated from the late 1970’s.  At the intersection, as he attempted a left-hand turn, the tractor was struck by a fully-loaded milk truck attempting to pass the tractor at the intersection. Plaintiff sustained life-threatening injuries and was air-lifted to Region’s Hospital in St. Paul, Minnesota, for an emergency decompressive craniectomy.   Other injuries included two collapsed lungs, numerous rib fractures, lacerated spleen, and a lacerated liver.
