  • Litigation costs directly affect a lawyer's ability to represent clients, case selection, and firm success. Most importantly, costs dictate the net amount of funds that a client recovers. In a practice primarily representing injured plaintiffs, obtaining medical records is one of the most frequent expenses incurred and a significant factor impacting every single case. The cost of medical records is typically paid for initially by the lawyer, but almost always becomes a cost borne by the client when expenses are reimbursed to the firm upon settlement or verdict. It is the unfortunate reality that the interest of patients and law firms contradict the interest of medical records copying companies that are incentivized to charge as much as possible to fulfill requests. This article discusses the historical background and Ciox ruling, and the options left for individuals and lawyers.  , Author, Medical Records Under HITECH: The Path Forward, The Verdict, Spring 2021 Issue, Legal, 2021
