Attorney Profile

A shareholder in Habush Habush & Rottier S.C., David Blinka focuses his practice exclusively on personal injury and wrongful death litigation. Practicing out of the firm's office in Madison, Wisconsin, he provides advice and counsel to residents of the area and other parts of the state. Mr. Blinka is admitted to practice in Wisconsin, and he is also admitted to practice before the U.S. District Courts for the Eastern and Western Districts of Wisconsin.

Mr. Blinka provides aggressive representation to people who have been harmed as a result of the negligence or recklessness of other parties, and he has handled both individual causes of action and mass tort claims. In one notable case, he was part of a group of the firm's attorneys that successfully represented a number of property owners in a small Wisconsin town who had suffered damages caused by groundwater contamination due to the rupture of a gas pipeline. Other types of cases that Mr. Blinka has worked on have arisen out of incidents involving motor vehicle crashes and defective products, and he has been able to obtain significant compensation for his clients, both through negotiated settlements and jury awards. His successful track record in and out of the courtroom, along with his high degree of ethics, have earned him the recognition of his fellow professionals, including a 10.0 "Superb" peer review rating through Avvo. In addition, the Wisconsin Law Journal named Mr. Blinka as an "Up and Coming Lawyer" in 2017.

Mr. Blinka received a Bachelor of Arts magna cum laude in history from Marquette University in 2006. After obtaining his Master of Arts in American history from the University of Wisconsin-Madison in 2008, he remained on campus to pursue his legal education at the University of Wisconsin Law School and was awarded his Juris Doctor cum laude in 2012.

  • Tort victims have long been seeking relief from the “jurisprudential chaos” of Wisconsin’s government immunity doctrine. While the struggle to find a clearer rule to dictate application of immunity continues, practitioners representing those who sustain injury as a result of government negligence still have good reason to embrace the decision from the most recent government immunity case, Engelhardt v. City of New Berlin. Decided on January 4, 2019, the Wisconsin Supreme Court held that governmentimmunity was not a defense to the City of New Berlin’s liability and that of its Parks and Recreation Department in the drowning death of an 8 year-old girl, Lily Engelhardt. The court arrived at a just result in a manner that applied an analysis of the known danger exception to government immunity that should help tort victims in future cases. , Author, Restoring the Known Danger Exception to Government Immunity, Legal, 2019
