Attorney Profile

David Blinka is a shareholder of the firm. He practices out of the Madison office where he has worked since 2012. David’s practice encompasses various personal injury cases, including wrongful death, product liability, and motor vehicle accidents. He began his career at Habush Habush & Rottier by assisting with the successful settlement of claims for over 200 property owners in the Town of Jackson, Wisconsin, who were impacted by groundwater contamination arising from the release of gasoline from a pipeline that ruptured.

Before joining Habush Habush & Rottier, David dedicated his efforts to serving the public’s interest in securing justice and protecting legal rights while learning trial practice as a volunteer prosecutor during law school. He has since been recognized as a Rising Star since 2014 by Super Lawyers and was distinguished as an Up and Coming lawyer in 2017 by the Wisconsin Law Journal. He has also previously made the Wisconsin Pro Bono Honor Society list by having provided volunteer legal representation to those in need of equal access to justice.

As a resident of Madison, David stays active in the legal community through his involvement with the Dane County Bar Association, having served on its board, and the Wisconsin Association for Justice, for which he has published articles on various litigation topics and presented at seminars for continuing legal education. Additionally, he volunteers for various programs conducted by the University of Wisconsin Law School to help prepare students for the practice of law and has also coordinated volunteer service projects and community activities through his work with the bar association.

In his free time, David enjoys reading history and engaging in outdoor activities at any time of the year.

  • Tort victims have long been seeking relief from the “jurisprudential chaos” of Wisconsin’s government immunity doctrine. While the struggle to find a clearer rule to dictate application of immunity continues, practitioners representing those who sustain injury as a result of government negligence still have good reason to embrace the decision from the most recent government immunity case, Engelhardt v. City of New Berlin. Decided on January 4, 2019, the Wisconsin Supreme Court held that governmentimmunity was not a defense to the City of New Berlin’s liability and that of its Parks and Recreation Department in the drowning death of an 8 year-old girl, Lily Engelhardt. The court arrived at a just result in a manner that applied an analysis of the known danger exception to government immunity that should help tort victims in future cases. , Author, Restoring the Known Danger Exception to Government Immunity, Legal, 2019
