Robert L. Jaskulski is a shareholder at the law firm, practicing in the firm’s Milwaukee, Waukesha and West Bend offices and is co-managing partner of the firm’s Waukesha office. Rob’s emphasis of law practice is personal injury litigation throughout the State of Wisconsin and the United States. His practice involves a wide range of cases, including medical malpractice, products liability, insurance bad faith and motor vehicle accidents. Rob is a member of the firm’s Defective Medical Device Team, handling defective hip cases and transvaginal mesh cases in multi-district litigation before Federal Courts in Ohio and West Virginia. Rob has represented many clients in disputes with insurance carriers and was involved as trial counsel in one of the largest insurance bad faith cases ever tried in the State of Wisconsin. Based on his extensive experience in the courtroom, Mr. Jaskulski has been certified in Civil Trial Advocacy by the National Board of Trial Advocacy.

Rob has received the distinction of being listed as a Super Lawyer in Wisconsin since 2005, and was listed as one of Wisconsin’s Top 50 Super Lawyers in 2009, 2011 and then in 2014-2018. He has also been listed as one of Milwaukee’s Top 25 Super Lawyers since 2013. Through his involvement in the Wisconsin Association for Justice (formerly the Wisconsin Academy of Trial Lawyers), where he held the office of President in 2007, Rob has been active in promoting the rights of Wisconsin consumers and has testified numerous times before the Wisconsin legislature. In 2015, the WAJ selected Rob for the Robert Habush Trial Lawyer of the Year. He was chosen for his outstanding contribution to public interest, demonstration of compassion and commitment to advocacy on behalf of injured individuals. He is also a Fellow in the International Society of Barristers, an Associate with the American Board of Trial Advocates and is on the Board of Governors for the American Association for Justice (formerly the Association of Trial Lawyers of America).

Rob is a lifelong resident of Southeast Wisconsin, living in the City of New Berlin with his wife of thirty years, Lisa. He has four grown children. Rob is active in his local parish and in local youth sports programs in Southeast Wisconsin.

  • Attorney Jaskulski settled a claim on behalf of the father of a 46 year old man who was struck and killed while riding his bike on County Line Road in the Town of Lisbon, Wisconsin.  The man died instantly when he was struck from behind by the driver of  a ground package delivery van who failed to see the man on the dark highway ahead driving his bicycle.  The claim was settled prior to the filing of a lawsuit with the driver of the van, his employer and their insurer for a confidential sum., 2021
  • Attorney Jaskulski settled a medical negligence lawsuit filed in Racine County Circuit court on behalf of a 62 year old man injured during a surgery at St. Lukes Medical Center in Milwaukee.  During an operation at St. Lukes, a guidewire used for the insertion of a radial arterial line implanted to monitor the man's vital signs during surgery was left in his body after the procedure.  The guidewire subsequently migrated up his arm and into his neck, injuring his vocal cord and requiring surgical removal.  The claim was settled in advance of trial for a confidential sum., 2021
  • Attorney Jaskulski settled a lawsuit pending before the Washington County Circuit Court brought on behalf of a six year old girl attacked and bitten in the face by a dog while she was visiting a neighbor’s house at the family’s lake home in Hiles Wisconsin.  As a result of the attack, the girl had to undergo cosmetic surgery and was left with scaring on her face, in the area of her right eye.  The case was settled in advance of trial for the sum of $230,000 against the owners of the dog involved in the attack.  , 2021
  • Attorney Jaskulski represented two individual's injured in a combustible dust flash fire in a foundry located in the City of Waukesha.  The two individuals suffered second and third degree burns to their face and hands.  The case involved a product liability/failure to warn claim against the manufacturer of a combustible dust product used in the foundry during casting of metal automobile parts.  The case was settled short of trial for a confidential sum.  , 2021
  • Attorney Jaskulski represented a 43 year old woman injured when her vehicle was rear-ended on the freeway in front of Miller Park.   The plaintiff suffered an injury to her cervical and lumbar spine that resulted in a cervical disk replacement surgery and the implantation of a spinal cord stimulator for ongoing lumbar pain.  The case was filed in Milwaukee County Circuit Court and settled in advance of trial for the sum of $750,000, 2020
  • Attorney Jaskulski represented a 50 year old woman who suffered injuries as a result of the implantation of transvaginal mesh manufactured by Ethicon/Johnson & Johnson.  The mesh was implanted to treat her pelvic organ prolapse.  The case was initially filed as part of Multi-District litigation in the State of New Jersey in 2012.  It was eventually remanded to the Wisconsin Federal Court for trial in 2019 after the plaintiff opted out of the global settlement agreement reached in the MDL with Ethicon/Johnson & Johnson. The case was tried for 5 days before a federal court jury in Green Bay Wisconsin in January of 2020, resulting in a confidential settlement on the fifth day of trial.  It was one of only a few cases in the thousands filed in the MDL that resulted in a jury trial against Ethicon/Johnson & Johnson., 2020
  • Attorney Jaskulski represented a 31 year old woman injured in a motor vehicle crash on the freeway.  The plaintiff was travelling on westbound Interstate 94 when her car was rear-ended in heavy traffic.  She suffered an injury to her shoulder that resulted in an arthroscopic shoulder surgery.  The case was tried in Milwaukee County Circuit Court and the jury returned a verdict in favor of the plaintiff in the amount of $128,000.  , 2019
  • Attorney Jaskulski represented a 60 year old woman injured when a car ran a red light at an intersection in West Bend, Wisconsin.  The woman treated for several years with a variety of medical providers, and eventually recovered from her injuries.  The case was tried in the Circuit Court for Washington County, and the jury returned verdict in favor of the plaintiff in the amount of $112,000, 2019
  • Attorney Jaskulski represented a 58 year old man who ran an HVAC business out of his home in Juneau, Wisconsin.  The business suffered a serious fire, which required salvage and demolition of the main building for the business.  The plaintiff was struck in the head by a tire rim thrown from a dumpster by an employee for a salvage contractor hired to remove a dumpster from the premises.  As a result, the plaintiff suffered a mild traumatic brain injury and psychological issues that prevented him from reopening his business after the fire.  The case was tried before a jury in Dodge County Circuit Court, and the jury returned a verdict in favor of the plaintiffs, awarding damages in the amount of $832,000., 2019
  • Attorney Jaskulski represented a 38 year old man injured in an automobile accident in Washington County, Wisconsin.  The plaintiff was travelling down the highway to work when his vehicle was side-swiped by another car attempting to pass in an area where the two lanes of the highway were merging into one.  The plaintiff suffered soft tissue injuries and underwent significant medical and chiropractic care and treatment.  The case was tried before in the Washington County Circuit Court, and the jury returned a verdict in favor of the plaintiff in the amount of $138,000., 2019
  • Attorney Jaskulski represented a 14 month old child who suffered a brain injury in a motor vehicle crash on Interstate 5 in Los Angeles California.   The family vehicle was struck from behind on the freeway, causing the driver-side seat to collapse into the rear occupant compartment.  When the seat collapsed, the plaintiff's father ramped over the driver seat into the rear occupant compartment, striking the plaintiff and causing a skull fracture and brain injury.   The plaintiff filed a product liability action against the manufacturer of the automobile seat claiming that the seat was negligently designed because it could not withstand the foreseeable forces of a rear-end collision without the potential for collapse into the rear compartment.  Several months before the scheduled trial in Los Angeles Superior Court, the case settled for a confidential amount., 2019
  • Attorney Jaskulski represented an individual who was rendered a quadriplegic when he stepped off an elevated scissor lift while assisting a friend install electrical wiring in a storage building located on the premises of a helicopter company in East Troy, Wisconsin.  The owner of the lift had removed one of the side railings and had positioned the lift in a location exposing the unguarded end of the lift.  The plaintiff died during the pendency of the litigation.  The case was settled in advance of trial for a confidential sum.  , 2019
  • Attorney Jaskulski represented the Estate of a 21 year old girl who died in a motor vehicle crash in the Town of Hartford, Wisconsin.  The deceased was a passenger in a vehicle being driven by her boyfriend southbound on Hwy. 83, near Waterford Road.  At the last second, the boyfriend decided to turn left on Waterford Road, and crossed the path of a dump truck which was approaching from behind and had shifted into the right turn lane to pass at the intersection.  After the crash, the vehicle caught fire with the deceased trapped inside in the passenger seat.  An action was filed against the boyfriend and the truck driver.  The claim against the truck driver was settled before trial for a confidential amount. The boyfriend had allowed his automobile insurance to lapse, so he had no primary coverage on the vehicle.  The car had been purchased by the boyfriend's father, who carried a $1 million umbrella policy on his "owned" vehicles.  A coverage trial was held in the Circuit Court for Washington  County and the jury returned a verdict finding that the father was an "owner" of the vehicle and that coverage would apply under the umbrella policy for the motor vehicle crash.  After verdict, the defendants paid the $1 million policy limits on the umbrella coverage., 2018
  • Attorney Jaskulski represented a 47 year old Illinois man injured in a snowmobile crash in Conover, Wisconsin.  The plaintiff was passing through a curve on a snowmobile trail when an oncoming snowmobile crossed the center of the trail, causing a collision.  As a result of the crash, the plaintiff suffered a severe fracture of his right leg requiring surgery and extensive medical treatment.  Because the operator of the other snowmobile was a resident of Milwaukee County, a lawsuit was filed in Milwaukee County Circuit Court.  Prior to trial, the action settled for payment for $1,250,000, 2018
  • Attorney Jaskulski represented a 37 year old woman who was rendered a paraplegic while doing landscape work at a lake home in the Town of Oconomowoc, Wisconsin.  At the time of the injury, the plaintiff was landscaping under a large oak tree.  A sudden gust of wind severed a decaying limb on the oak tree, which fell to the ground, striking the plaintiff and causing her spinal cord injury.  The tree had been trimmed by a tree trimming service on behalf of the local utility company approximately a month before the incident, but the company did nothing to remove the decaying limb.  A suit was filed in the Circuit Court for Waukesha County against the utility and the tree trimming service.  The case was resolved pursuant to a confidential settlement before trial.  , 2017
  • Attorney Jaskulski represented a 54 year old farmer injured in a motor vehicle cars in the Town of Lomira.  The plaintiff was driving his tractor and gravity box back to the farm on Highway 175 when his tractor was rear-ended by another vehicle.  As a result of the crash, the plaintiff suffered an aggravation of pre-existing arthritis in his neck and back, post concussive syndrome and Post Traumatic Stress Disorder.  The case was filed in the Circuit Court for Dodge County and settled prior to trial for $850,000 , 2016
  • Attorney Jaskulski represented an on-duty Milwaukee County Sheriff's Deputy injured in a high speed chase with a drunk driver on the Milwaukee County freeway.  The driver was operating his mother's car when he fled after the plaintiff attempted to pull him over.  The high speed chase resulted in a crash near Miller park.  As a result of the crash, the plaintiff suffered an ankle injury, low back injury, post concussive disorder, depression and anxiety and a chronic pain disorder that prevented him from returning to duty as a Milwaukee County Sheriff.  An action was filed in Milwaukee County Circuit Court and the case was settled before trial for payment of $1,300,000., 2016
