  • PI - Slip/Fall This civil case involved a customer at a McDonalds in Menomonie, WI tripping after his one-year-old granddaughter kicked up the corner of a floor mat.  A three-day trial was held in August 2017 on the issues of liability and damages.  Defendants had a video of the fall clearly showing the little girl caught the corner of the mat with her foot and as it turned up, it caught the plaintiff’s foot.  As he fell, he reached out to catch himself and landed on his hands and knees.  Plaintiff argued the mats were unsafe and that Defendants had notice they were easy to kick up and cause tripping hazards, particularly by little children.  There was evidence these mats caused prior falls to customers and employees in other parts of this particular store and in other stores owned by the Defendants.  There was also evidence of employees using temporary fixes to keep the corners of other mats down at times.  Defendants contended the mats were safe, and that the few incidents before and after were not statistically relevant. The court initially refused to allow testimony about incidents after the plaintiffs fall.  Based on defendants’ testimony, the court later permitted the jury to hear about incidents after plaintiff’s fall.  Injuries claimed were a torn rotator cuff that was inoperable due to unrelated terminal illness. Plaintiff’s physician concluded the injuries were permanent without surgery and future care was limited to pain-relieving injections.  Defendants argued the rotator cuff tear was unrelated and could not have been caused by the fall.  Defendants offered testimony by Dr. Paul Wicklund who performed a medical evaluation of the plaintiff.  Dr.  Wicklund initially concluded the fall did cause the shoulder tear.  After watching the video of the fall, he changed his opinion, concluding plaintiff did not fall in a way that was consistent with the torn shoulder.  The jury found the Defendants negligent and 100% at fault for causing the fall and associated injuries.  There was one dissenter on the issue of whether Defendants negligence caused the fall.    Verdict $219,187.16 Past Medical Expenses                              $27,387.76 Future Medical Expenses                           $16,800.00 Past pain, suffering and disability               $15,000.00 Future pain, suffering, and disability          $160,000.00  , 2017
