Defense Attorneys:  Deborah Bejonerud and Melissa Zamora, Phillip Anderson and Associates    Facts & Allegations:  On November 1, 2015, Plaintiff, a 36-year-old African American woman, was driving on University Avenue in East Palo Alto, when she was T-boned on her driver’s side door by the defendant, who was driving in the opposite direction and attempted to make a left turn against the red arrow traffic signal.    Plaintiff was seen at the emergency room the date after the accident and then received treatment (mainly chiropractic) for neck and lower back pain until she got pregnant in February of 2016. She suspended treatment until after her baby was born in the fall of 2016, then resumed treatment with her primary care physician. Two years after the accident, she had a lumber MRI that revealed disc protrusion with nerve involvement. She underwent several rounds of physical therapy in 2017 and 2018.   At trial, Plaintiff waived past medical specials and past income loss, since her income loss was insignificant and her medical bills for the most part were covered by State insurance plan.   Defendant disputed liability, causation and damages. Defendant’s disputing of liability allowed Plaintiff to introduce into evidence a video recording she made at the scene, of Defendant admitting to her and to the police officer that he made an unsafe turn on a red arrow.   In regards to plaintiff’s injuries, Defendants argued that that plaintiff’s back condition was pre-existing and/or due to the pregnancy.  Defendants asked to jury to award money for first 6 weeks of treatment.  Plaintiff’s retained expert, Dr. Gary Martinovsky recommended future injections and surgery.
