Attorney Profile

Based in Boston, Massachusetts, Hillary Schwab is the co-founder of Fair Work P.C. She focuses her practice exclusively on employment law, representing current, former and prospective employees around the state in a variety of matters. Ms. Schwab has a particular emphasis on wage and hour claims and on both individual and class action lawsuits brought on behalf of service and wait staff workers against employers that have improperly distributed or withheld tips and service charges. She also represents employees whose employers have misclassified them as independent contractors, and she handles cases involving retaliation, unfair termination and disability, race and sex discrimination.

Ms. Schwab attended Brown University as an undergraduate and received a Bachelor of Arts in classics in 1995. She then enrolled at Columbia Law School and was on the Columbia Law Review before being awarded her Juris Doctor in 1999. After serving a clerkship with a judge on the U.S. District Court for the Southern District of New York and then another with a judge on the U.S. Court of Appeals for the 3rd Circuit, Ms. Schwab spent a year as a trial attorney with the Center for Reproductive Rights in New York City, litigating cases around the country. She then moved to Wisconsin, first representing victims of domestic violence and then serving as an assistant attorney general with the Wisconsin Department of Justice.

Admitted to practice in Massachusetts and New York, Ms. Schwab is also admitted to practice before the U.S. District Court for the District of Massachusetts, the U.S. District Court for the Southern District of New York, the U.S. District courts for the Eastern and Western Districts of Wisconsin, and the U.S. Courts of Appeals for the 1st, 3rd, 5th, 7th and 11th Circuits. She has received a "Superb" peer-review rating through Avvo.
