M. Brandon Maggiore

Brandon Maggiore is a Senior Associate in Robinson & Henry’s civil litigation practice. He specializes in trust and estate litigation, guardianship, fiduciary representation, and other complex matters.

Prior to joining R&H, Brandon co-founded and ran his own firm handling estate matters and construction defect litigation. He also gained financial expertise as a Special Needs Trust Officer in the field of banking. He has also been an assistant public defender.

Brandon was recognized as a Super Lawyers Rising Star in Estate and Trust Litigation in 2019.

Representative Matters

• Negotiated a settlement agreement in a common law marriage dispute that resulted in the client being declared the decedent’s spouse and allowing her to maintain over $1.2 million in assets and real estate.

• Successfully modified a deceased person’s will to conform to his intent after his death due to a drafting error by the estate planning attorney, ensuring that the decedent’s children were not required to share their father’s estate with his stepchildren, whom he had disinherited.

• Obtained a settlement agreement ensuring clients received over $350,000 in funds on deposit with banks as well as their late mother’s retirement accounts where someone attempted both pre and post-death beneficiary changes.

• Obtained a judgment for all attorney’s fees and costs claimed by a professional fiduciary in a five-plus year highly litigated estate case after a two-day trial under the Cost and Compensation Statute.

• Successfully enforced a mechanic’s lien through a negotiated settlement against an estate for work done on behalf of the estate where the estate refused to pay for the construction work claiming it was barred by statutes regarding claims against a decedent’s estate and a claim that the person who authorized the work was not legally able to bind the estate or receive notice of the mechanic’s lien.

• Identified that two houses owned by an estate and another person were not owned in equal shares by investigating the original purchases of the properties and obtained a settlement agreement wherein the estate was able to maintain over 90% ownership in each property as opposed to the originally claimed 50% by the opposing party.

• Obtained over $225,000 in settlement proceeds payable to client in a dispute over probate and non-probate transfers avoiding a Will contest and a dispute over non-probate transfers of real property.

• Obtained a judgment in favor of client for treble damages for theft from an estate by a fiduciary, including treble damages totaling over $200,000.
